How Severance Pay Works in Ontario

When you are terminated without cause in Ontario, your employer may owe you significantly more than the Employment Standards Act (ESA) minimums suggest. Under common law, most non-unionized employees are entitled to up to 24 months of severance pay, calculated based on factors like age, length of service, and the nature of your role. The ESA sets out the absolute minimums, but most employees — especially those with several years of service or senior positions are entitled to far more. Don’t sign before your full entitlement is reviewed.

Age & Service

Older employees with longer tenure typically receive higher severance. The courts recognize re-employment difficulty as a key factor.

Your Job Title

Senior or specialized roles can attract higher severance if re-employment in a comparable position would take longer to find.

Your Contract

A poorly drafted employment contract may actually limit your severance. An employment lawyer can review whether such clauses are enforceable.

Don't Sign Too Fast

Once you sign a severance offer you generally cannot renegotiate. Always consult with an employment lawyer like Taman Singh first.
